Trump's Framework of Punishment and Favor

The ex-president's intense appetite for revenge has swiftly transformed into a structured system. Within the past year, the chief executive's fury and caprices have adopted the guise of government actions in a manner analogous to past repressive governments. Federal personnel who resist his demands are summarily fired and succeeded by supporters. Political figures who challenge him encounter legal action, trial and punishment. Adversaries have been designated under administration directives as “anti-American”, “anti-Christian” and “anti-capitalist”, and threatened with prosecution as “extremists”.

The Justice System Restructured

Every case involving legal action of Trump's enemies and leniency for loyalists displays its own unique characteristics. However, despite their individual character, they embody examples of what has emerged as a systematic method. Those events are not random. Trump's cleansing of DoJ attorneys and law enforcement agents, alongside his placement of loyalists in key posts, commenced quickly, soon assumed a consistency, and has now been formed into a regime. DoJ and the FBI have been remade into partisan agencies under the president's explicit direction to implement his directives. Injustice has been made standard. It constitutes the apparatus of revenge.

Administration is more concerned with penalizing the President's perceived enemies than they are with defending our national security.

Within the Apparatus

The beginnings of this system has been revealed in the court filing of three ex- senior FBI agents filed in late summer in the federal court in Washington against FBI director Kash Patel and attorney general another official for wrongful dismissal in “a campaign of retribution against Plaintiffs for what Defendants considered to be a refusal to show proper devotion”. In the complaint that one official, the previous temporary head, describes a discussion in which the director “freely acknowledged the unlawfulness of his actions”.

The official had sought to shield law enforcement officers from being dismissed, the lawsuit states. Patel advised him that “White House figures” – perceived by Driscoll to be the executive branch and federal prosecutors – had instructed him to fire all those who they identified as having worked on a legal probe against him. The document goes on: “Patel stated that he had to terminate the personnel his bosses told him to remove, because his ability to keep his own position was contingent on the ouster of the officials who were involved in investigations involving the chief executive. The director noted that there was no way he or the official could do to halt these or any other dismissals, because ‘the agency attempted to incarcerate the leader in jail and he recalls it clearly.’” After Driscoll told Patel he was breaking the bureau's own internal rules, Patel allegedly said “he understood that and he knew the nature of the swift terminations were likely illegal”.

Broad Impact

Since his reported admission to the official, the Department of Justice and the law enforcement agency have been weakened and redirected for his revenge apparatus. Six of the FBI's senior executives were terminated or forced out in the early weeks of the presidency. About numerous lawyers at DoJ have taken a “deferred resignation program”. A minimum of multiple federal prosecutors, including those in the southern district of New York, stepped down in dissent over what they regarded as political interference in dropping the corruption case against the city leader, a political figure, in return for his cooperation with his federal agency roundups of migrants. The public integrity section of the department, which handles misconduct investigations, has been reduced to two attorneys. The rights protection unit has been devastated: 70% of its personnel has resigned. One-third of top officials at the department have resigned. The unit enforcing conservation statutes has lost a majority its management.

Incentives and Penalties

Concerning the legal matter, the interim prosecutor for the southern district of New York, Danielle Sassoon, resigned in dissent against what she labeled as the “trade-off”. The border official, the president's “enforcement chief,” was present as the agent with Adams on Fox News to declare: “Should he fail to deliver, I will return in New York City.”. And, a former official, formerly the justice department figure and a past legal representative, who arranged the arrangement, was awarded an appellate federal judgeship, a potential pathway to the judicial branch.

Trump's protection for offenses carried out while in office, provided by the remarkable ruling of the Republican majority on the highest court, thus blocking his legal action over the January 6 insurrection and preserving his electoral prospects for the national vote, is the cornerstone on which he depends to protect his loyalists. Under these circumstances, he has been empowered to authorize wrongdoing. The impact of the judicial ruling saturates his administration and the political party thoroughly. The legal case has metastasized. In the words of Richard Nixon's legal adviser John Dean commented about the Watergate
